It is advisable to read these "General Conditions of Use" carefully before using the services of Cantina Sabauda. By using the services you accept these General Conditions of Use in their entirety. Cantina Sabauda offers a wide range of services and it is sometimes possible to be subject to additional terms and conditions. In the event of a conflict between these General Terms of Use and the Terms of Service, the Terms of Service shall prevail.

 

Electronic Communications 

When using the services of Cantina Sabauda or when e-mails, text messages (SMS) and other communications are sent from your computer or mobile device, you communicate electronically. You can communicate in a variety of ways, for example by email, text messages (SMS) or by posting messages and communications on the Site or through other services. Without prejudice to specific mandatory legal provisions, for the purposes of this contract, it is accepted that all contracts, notices, notices and other communications which are provided electronically comply with the requirement of written form, where required by law.

The graphic material, page headers, logos, fonts and service marks included or made available through any of the Services of Cantina Sabauda are trademarks or distinctive signs of Cantina Sabauda; they may not be used in relation to products or services that are not Cantina Sabauda, in such a way as to cause confusion among customers or in any way that may denigrate or discredit Cantina Sabauda. All other trademarks not owned by Cantina Sabauda appearing on any of the Cantina Sabauda Services are the property of their respective owners, who may or may not be related, connected to Cantina Sabauda or sponsored by Cantina Sabauda.

 

Licence for access to the services of Cantina Sabauda

 Provided you comply with these General Terms of Use, the Terms of Service and pay any applicable fee, Cantina Sabauda or its content provider grants you a limited, non-exclusive, non-transferable and non-sublicensable licence to access and use the Cantina Sabauda Services for your personal use. This license does not include any right to resell or use the Cantina Sabauda Services or its contents for commercial purposes, nor the right to collect and use product lists, descriptions or prices, make a derivative use of Cantina Sabauda Services or their contents, download or copy any account information for the benefit of another reseller, or use data mining, robots or similar data acquisition and retrieval devices. All rights not expressly conferred by these General Conditions of Use or the Terms of Service remain with Cantina Sabauda or its licensors, suppliers, owners or other service providers. It is not possible to reproduce, duplicate, copy, sell, resell, visit or in any other way use for any commercial use the services of Cantina Sabauda in whole or in part without express written consent. You may not frame or use framing techniques to misappropriate any trademark, logo or other proprietary information including images, text, page settings or format of Cantina Sabauda without the express written consent of Cantina Sabauda. It is not possible to use any meta tags or any other "hidden text" using the name or trademarks of Cantina Sabauda without the express written consent of Cantina Sabauda. It is not possible to use Cantina Sabauda's services improperly. It is possible to use Cantina Sabauda's services exclusively within the limits provided by law. Violation of these General Conditions of Use or the Terms of Service will result in revocation of the authorisation or licence issued by Cantina Sabauda.

 

Personal Account

You may be required to use your Cantina Sabauda account to use certain Cantina Sabauda services by logging in and having a valid payment method associated with it. If there is a problem charging to the designated payment method, Cantina Sabauda may charge to any other valid payment method associated with your account. By using the services of Cantina Sabauda, you are obliged to keep your account and password data confidential, to control access to your computer and devices and to agree, to the extent permitted by applicable legal provisions, to be held responsible for all activities that will be carried out with your account and password. The customer must undertake to take all necessary precautions to ensure that the password remains secure and confidential and undertakes to inform Cantina Sabauda immediately if he or she has reason to believe that a third party has knowledge of the password or that it is, or is likely to be, used in an unauthorised manner. The buyer is obliged to ensure that the data provided is correct and complete and to immediately notify any changes to the information provided. You can access the information from the My Account section of the site. It is not possible to use the services of Cantina Sabauda: in such a way as to cause or to cause interruptions, damage or malfunction to the services of Cantina Sabauda and its functions; for fraudulent purposes, to commit illicit activities, to cause disturbance, prejudice or apprehension. Cantina Sabauda reserves the right to prevent access to the services of Cantina Sabauda or to terminate the account if the behaviour constitutes a justifiable reason to do so; in particular, this will be done in the event of a breach of the applicable law, the applicable contractual provisions, the guidelines or the policies of Cantina Sabauda, all of which are accessible on the website of Cantina Sabauda. Despite such restriction or closure, you can continue to have access to the content and services you have purchased up to that point.

 

Reviews, comments, communications and other content

You may post reviews, comments and other content, send communications and submit suggestions, ideas, comments, questions or other information, provided the content is not unlawful (obscene, abusive, intimidating, defamatory; does not violate privacy, intellectual property rights or is not otherwise offensive or offensive to Cantina Sabauda and/or third parties and does not contain, or otherwise does not contain, viruses, political propaganda, commercial solicitation, St. Anthony's chain and the like, mass e-mail or any other form of spamming). By posting on a Cantina Sabauda Service, you represent and warrant that you have, personally or otherwise, the ownership or availability of all rights relating to the content of what you post and that it is not contrary to any of Cantina Sabauda's applicable policies and guidelines and that such use will not cause any harm to third parties. Without prejudice to cases where any liability arises from the failure to remove illegal content following receipt of a notification, you undertake to hold Cantina Sabauda harmless from all legal actions taken by third parties against Cantina Sabauda arising out of or otherwise related to the content and materials provided by you.

 

Infringements of Intellectual Property Rights

Responsibility

Cantina Sabauda will do its best to ensure that access to Cantina Sabauda's services is provided without interruption and that transmissions are error-free. However, due to the nature of the Internet, uninterrupted access and error-free transmission cannot be guaranteed. Access to Cantina Sabauda's services may also be suspended or restricted from time to time, allowing repairs, maintenance and the introduction of new activities or services. Cantina Sabauda will endeavour to limit the frequency and duration of such suspensions and restrictions. Cantina Sabauda shall not be liable for any loss that is not a consequence of the breach of these terms and conditions or for any loss of business opportunity (including lost profits, revenues, contracts, presumed savings, data, goodwill or unnecessarily incurred expenses) or any other indirect or consequential loss that was not reasonably foreseeable at the time the customer started using the Cantina Sabauda Services. Cantina Sabauda will not be liable for delays or non-fulfilment of the obligations provided for in these terms and conditions if the delay or non-fulfilment is due to unforeseeable circumstances or force majeure. This provision shall be without prejudice to legal rights and in particular to the right to receive the goods purchased within a reasonable time or to be reimbursed in the event of non-delivery due to unforeseeable circumstances or force majeure. The legal provisions of some jurisdictions may prohibit the limitations of liability here indicated. If such provisions are applicable, the limitations of liability here indicated will not have effect and you may be entitled to additional rights. Nothing herein limits or excludes our liability for death or personal injury caused by our negligence or wilful or gross negligence.

 

Applicable law and competent court

These General Terms and Conditions of Use are governed by and shall be interpreted in accordance with Italian law (with the exception of the conflict of laws provisions). You agree, and we agree, to submit to the exclusive jurisdiction of the Courts of the District of Turin. Export Control

You agree not to export, re-export or transfer any product (including software or other digital products) that you have purchased from Cantina Sabauda Services to any country, person, company, organization or entity to which such export is restricted or prohibited by law. For example, economic sanctions and embargoes imposed by the European Union, the United Nations, the United States Departments of State, the Treasury or Commerce, and other governmental authorities (such as embargoes imposed on specific countries, or economic sanctions imposed on individuals or companies for terrorism or money laundering offences) may prohibit you from bringing products, including for your personal use, to other countries, and/or from sending products (whether physically by mail or digitally via email or through file sharing) to specific individuals, companies, organizations or entities. In addition, you agree not to purchase any products or services from the Site if you are subject to restrictive measures (sanctions).

 

Changes in service or changes in conditions

Cantina Sabauda reserves the right to modify Cantina Sabauda's services, policies, these General Conditions of Use and the Terms of Service at any time to offer new products or services or to comply with legal and regulatory provisions. The customer is subject to the policies and terms of the General Conditions of Use from time to time in force at the time the services of Cantina Sabauda are used. If any of these terms are held to be invalid, void, or for any reason unenforceable, this shall not affect the validity and effectiveness of the remaining terms.

 

Waiver

In the event of non-compliance with these General Conditions of Use, Cantina Sabauda's failure to exercise its right to take action against you does not constitute a waiver of Cantina Sabauda's right to take action for breach of the obligations assumed by the customer.

 

Minors

Cantina Sabauda does not sell products to minors. Children under the age of 18 may use Cantina Sabauda Services only with the involvement of a parent or guardian.

GENERAL CONDITIONS OF SALE

 

These General Terms and Conditions of Sale govern the sale of products and, where applicable, services through the site when Cantina Sabauda acts as the vendor "General Terms and Conditions of Sale". Cantina Sabauda offers a wide range of services and it is sometimes possible to be subject to additional terms and conditions. If you use any of Cantina Sabauda's services, you will be subject to the terms, guidelines and general conditions applicable to that particular service "Terms of Service". In the event of a conflict between these General Terms of Sale and the Terms of Service, the Terms of Service shall prevail.

Please read these General Terms and Conditions carefully before making any purchase. By making any purchase you accept these General Terms and Conditions in their entirety. If the Customer is a consumer, once the online purchase procedure has been completed, he/she will print or save an electronic copy and, in any case, keep these general terms and conditions of sale, in compliance with the provisions of articles 3 and 4 of Legislative Decree 185/1999 on distance selling.

 

The contract of Cantina Sabauda
To buy one or more products, you can select them one at a time, adding them to your shopping cart. Once all the items you want to buy have been selected, you can close the shopping cart and place your order. You will then see a summary page of the selected products, their price and delivery options (with related costs). You will be asked to choose your preferred delivery solution, transport and payment method.
The order will then be considered as your contractual offer to Cantina Sabauda for the products listed, considered individually. Upon receipt of the order, Cantina Sabauda will automatically send you a message accepting the order. The Order Receipt does not constitute acceptance of the purchase proposal. By sending the Order Receipt, in fact, it is only confirmed that the order has been received and that it has been subjected to a process of data verification and availability of the requested products. The sales contract with Cantina Sabauda will only be concluded when we send you a separate e-mail which will also contain the information regarding the shipment of the product and the expected date of delivery. In the event that the order is processed by more than one shipment, you can receive separate Shipment Confirmations. It is possible to cancel your order before you have received the Shipping Confirmation, as long as the order has not been prepared for the shipping process. In this case, no fee will be charged. You agree to receive the invoices in electronic format, these documents will be forwarded in PDF format to the e-mail address provided and will be stored in your tax drawer. The issuance of the electronic invoice relating to an order will be communicated to you in the Shipment Confirmation. The sales contract between the Customer and Cantina Sabauda is deemed to have been concluded in Italy and governed by the law. For the settlement of civil and criminal disputes arising from the conclusion of this distance sales contract, the territorial jurisdiction is exclusively that of the Turin Court. Cantina Sabauda cannot be held liable for any delay in the processing of the order or in the delivery of the goods ordered. Any delivery and/or incidental costs shall be borne by the customer and shall be clearly stated at the time the order is placed. The payment of the goods by the Customer will be made using the method chosen at the time of the order. Nothing is owed by the Customer in excess of the total amount of the order indicated at the end of the purchase procedure.

 

Right of withdrawal, exceptions and return policies

Subject to the exceptions indicated below, you have the right to withdraw from the order placed, without having to give any reason, within 14 working days of the dispatch and/or delivery of the product ordered (or the last product, lot or piece in the case of goods, lots or multiple pieces delivered separately) or of the conclusion of the contract.
In order to exercise the right of withdrawal, the relevant notice must be sent before the expiry of the period of 14 working days and the product must be returned to the headquarters of Cantina Sabauda, Via Oropa 76, 10153 Turin. For more information on the right of withdrawal and operating instructions, please contact Cantina Sabauda Customer Service. Each bottle had its own storage history and was checked before being sold by the Cantina Sabauda team. However, for the bottles we have kept for many years, we cannot guarantee that the wine is still perfectly preserved. Cantina Sabauda guarantees that the condition of the bottle is exactly as described in the description and picture on the product page. Any right of the Customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an order, is excluded.

Effects of the exercise of the right of withdrawal
All payments received in relation to the product for which the right of withdrawal has been exercised will be refunded, within 14 days of receipt of such product. The refund will be made using the same payment method used to place the order, unless expressly agreed otherwise. In any event, no costs will be incurred as a result of such refund. You are obliged to return the products to the registered office of Cantina Sabauda within 14 working days from the day on which you are notified of your withdrawal. You are obliged to bear the direct costs of returning the products. There is the possibility of being held liable for a decrease in the value of assets resulting from handling of assets (other than that required to establish the nature, characteristics and functioning of the assets).

Exceptions to the right of withdrawal

The right of withdrawal shall not apply in the case of:

• Supply of sealed goods which cannot be returned for hygiene or health reasons and which have been opened after delivery or in the case of Supply of products which are, after delivery, inseparably mixed with other goods;

• Supply of tailor-made or clearly personalised goods; non-performance of the contract;

• The supply of alcoholic beverages, the price of which has been agreed when the sales contract is concluded, the delivery of which cannot take place until 30 days later and the actual value of which depends on market fluctuations beyond Cantina Sabauda's control;

• Supply of goods liable to deteriorate or rapidly expire;

• Service contracts after the complete performance of the service by Cantina Sabauda, expressly allowing the performance of the service by Cantina Sabauda, the loss of the right of withdrawal following the performance of the service is accepted.

Return policies Cantina Sabauda
In addition to legal rights, products sold by Cantina Sabauda may be returned to Cantina Sabauda within 14 days of delivery, subject to exceptions to the right of withdrawal, provided they are intact and under the same conditions as they were delivered. To return a product, write or call us. Cantina Sabauda will only refund the price paid for the purchase. We will not refund the shipping costs incurred to receive the item you are returning. The risks arising from the shipping and the costs of the return will be your sole responsibility. These provisions are additional and do not affect your legal rights or the right of withdrawal within 14 days described above.

 

Prices and Availability

All prices are inclusive of legally applicable VAT. Information on the availability of the products that are sold is listed on the website, as well as on the presentation page of each product. Apart from the information provided on this page or elsewhere on the website, Cantina Sabauda is not able to give any more precise indications as to the availability of the products. Please note that the estimated shipping and delivery times for the products are purely indicative and cannot be relied upon. Once the order has been received, we will inform you by e-mail if some of the products ordered are not available. Despite our best efforts, Cantina Sabauda cannot exclude the possibility that for a small part of the many products in the catalogue a price different from the actual one may be erroneously indicated. The correctness of the prices of the products is checked during the process of verification of the order and subsequent shipment of the products. If, due to problems or other inconveniences, the price indicated on the site should be lower than the correct selling price of a product, the Customer will be contacted to verify if he also wishes to purchase the product at the correct price, alternatively Cantina Sabauda may not accept the order. If the correct price of a product is lower than the price shown on the site, we will charge only the lower correct price and ship the product anyway.

 

Customs

Should the goods ordered by Cantina Sabauda be delivered outside Italy, they may be subject to import duties and taxes, which are payable once the parcel reaches the specified destination. Any additional customs clearance costs will be borne by the customer. Cantina Sabauda does not control these costs and cannot predict the amount. Customs policies vary considerably from country to country and it is therefore important to contact your local customs office for further information. When placing orders on the site, you are considered as an importer and are therefore required to comply with all laws and regulations of the country where you will receive the goods. Privacy is important to Cantina Sabauda; our international clients and clients shipping products abroad should be aware that cross-border deliveries are subject to opening and inspection of the products by customs authorities.

 

Guarantees on products sold by Cantina Sabauda and limitations of liability 

Anyone who buys as a "consumer" benefits from the statutory warranty of conformity that the seller is bound by law on every good sold "Legal Warranty". The Legal Warranty guarantees the good against defects in conformity with the sales contract. In accordance with the law, if the Legal Warranty is applicable, you shall have the right to restore the conformity of the goods without charge by repair or replacement, or, if this is not possible, to a reduction in the purchase price or termination of the contract. Cantina Sabauda is therefore liable for the defects in conformity if they appear within a period of one month from the date of delivery of the goods. However, it will be the duty to report the lack of conformity within the pre-established period. In the event that there is a lack of conformity on the goods purchased by Cantina Sabauda during the period of validity of the Legal Warranty, please contact Cantina Sabauda Customer Service. To the extent permitted by law, Cantina Sabauda declines all responsibility in the event that the delivered product does not comply with the law of the country of delivery other than Italy. Cantina Sabauda will not be liable in the event of a delay in the delivery of the purchased goods due to insufficient stocks at the supplier. Cantina Sabauda will not be liable in the event of non-substantial differences between the goods and their illustrative pictures and text descriptions published on the website of Cantina Sabauda. Except in the case of intent or gross negligence, Cantina Sabauda is solely liable for any direct and foreseeable damage at the time of the conclusion of the sales contract. Cantina Sabauda shall therefore not be liable for any losses incurred, loss of profit or any other damage which is not an immediate and direct consequence of our default or which was not foreseeable at the time of the conclusion of the sales contract. All products sold by Cantina Sabauda are covered by the legal guarantee of conformity provided for by the Consumer Code. The legal guarantee is reserved for consumers and applies only to users who purchase for purposes unrelated to their professional, business or commercial activity. Those who have purchased and do not have the status of consumer will be subject to the guarantees for defects in the goods sold, guarantee for defects of promised and essential quality and the other guarantees provided by the Civil Code with the relevant terms, forfeitures and limitations. 

 

Changes to the General Conditions of Sale 

Cantina Sabauda reserves the right to modify the website, the policies and these General Terms and Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory provisions. The Customer shall be subject to the policies and terms of the General Terms and Conditions of Sale from time to time in force at the time the products are ordered from Cantina Sabauda, unless any changes to such policies and terms are not required by applicable law or by the competent authorities. If any of these terms are held to be invalid, void, or for any reason unenforceable, this shall not affect the validity and effectiveness of the remaining terms.
